SCC Confirms Decision from Trade-mark Opposition

The Supreme Court of Canada dismissed an application for leave to appeal a decision of the Federal Court of Appeal in which our client successfully opposed an application by a Punjabi-language newspaper based in India to register the word AJIT in association with printed publications and newspapers. The case involved issues regarding the acquisition of distinctiveness in Canada and the relevance of allegedly infringing competing use of the trade-mark. By dismissing the application for leave to appeal, the Supreme Court confirmed the decision of the Federal Court of Appeal that dismissed appeals from the Federal Court and Trade-marks Opposition Board.
